ISOO Notice 2021-02 Provides Partial Waiver for the Declassification Review of Certain White House, National Security Council, and Homeland Security Council Records

On July 16, 2021, Mark A. Bradley, Director of the Information Security Oversight Office (ISOO), signed ISOO Notice 2021-02: Partial Waiver for the Declassification Review of Certain White House, National Security Council (NSC) and Homeland Security Council (HSC) Records. This Notice cancels ISOO Notice 2017-03.

This new Notice provides further relief to declassification reviewers across the Federal Government from the predecessor Notice, extending the previously authorized period of the partial waiver through the second term of the George W. Bush Administration and applying to classified information created prior to January 20, 2009. The Notice directs declassification reviewers  not to refer selected classified information to the NSC for declassification review that either was transferred or is intended for transfer to the National Archives and Records Administration (NARA) following declassification review. The Notice also contains the exclusive list of categories for which agencies must continue to refer selected classified information originated by the NSC, the HSC, and the White House to the NSC for declassification review.

The Notice applies to all such records that are the subject of Executive Order 13526: Automatic Declassification, Systematic Declassification, or Mandatory Declassification Reviews, as well as to those requests made under the Freedom of Information Act.
